    Sandage Bell represents individuals against federal and state charges of theft, fraud, and embezzlement. We defend clients against many different charges, from burglaries, robberies, and false record keeping to complex cases alleging mail, wire, and other forms of fraud. In complex white-collar matters, the government’s case typically turns on questions of intent. And the answers to those questions are only found in lengthy financial documents, complicated accounting procedures, and testimony from experts in very specialized areas. The firm is often able to resolve such matters before charges are ever filed.
    Sandage Bell has extensive experience representing clients against allegations of serious violent crimes, including assaults, armed robberies, weapons charges, homicides, and murders. Our attorneys have experience representing individuals who face a potential death sentence for their alleged crimes. If convicted, clients often face long prison sentences and then lifetime registration as a violent offender. Clients charged with violent crimes need an attorney committed to conducting thorough investigations, drafting winning pretrial motions, and winning trials. Sandage Bell has a long and proven history of success in each of these areas.
    The prosecution often tries to impose taxes and SEIZE the proceeds of what they believe to be criminal conduct. Most of the time, the government can seize assets before they prove someone has done anything wrong. The government can also estimate how much it thinks a person may have made by engaging in criminal conduct and then impose tax liability for that income. Our firm has been successful in reducing or eliminating these financial penalties altogether.
    The penalties associated with state and federal sex offenses—production and possession of child pornography, sexual assaults and rapes, prostitution, solicitation, and similar offenses—have increased dramatically. Law enforcement's focus on these crimes increased commensurately. A sex-crime conviction will often mean substantial prison time and then lifetime sexual offender registration; public humiliation; professional censure; and social ostracism.
    Sandage Bell has represented many clients facing these kinds of charges. We thoroughly defend these cases by completely understanding the client’s psychological condition, gaining the assistance of medical experts to review medical records, and retaining former law enforcement investigators to interview witnesses regarding the accuser’s possible motivations. We can resolve these matters discreetly and with a minimum of public attention.
    Sandage Bell garners outstanding results in federal and state sentencing proceedings, including diversions, probation, and suspended sentences. Many of our clients face collateral consequences upon conviction including: loss of professional licensing, professional privileges, and immigration status. We often resolve cases in a way that avoid or minimize these adverse consequences.
    Sentencing advocacy demands expertise and creativity. Sandage Bell has extraordinary experience in representing clients at the sentencing stage. Our attorneys find creative ways to deliver the most favorable sentences possible. The firm has obtained sentences of probation, home detention, or community confinement for its clients, often over the government’s recommendation of lengthy prison terms.

    Representative Cases

    Client found guilty of a charge that carried a maximum term of life imprisonment. The probation department recommended a term of nearly four years. Our attorneys convinced the judge to give the client a term of house arrest and probation.
    Sometimes a client loses because the trial court made a mistake. Sandage Bell has significant experience litigating those mistakes in state and federal appellate courts. Success requires thorough study of the trial court transcripts, knowledge of the law, and understanding of appellate procedure. The firm’s attorneys possess all of these crucial skills.

    Representative Case

    At trial, our client was convicted of 55 convictions. Although we did not represent the client at trial, we handled the appeal. Our attorneys convinced the appellate court to reverse all 55 convictions and saved the client from a mandatory life sentence.

    Sandage Bell represents individuals and corporations in criminal enforcement actions regarding securities fraud, insider trading allegations, false statements on financial statements, and misstatements to investors.
    The firm also represents clients facing investigation by multiple agencies at once. A corporation could be looking at investigation by the SEC, the state securities commissioner, the United States Attorney, the New York Attorney General, and the Attorney General of the state where the company is located. Some of these investigations will be civil, some will be criminal, and the line between them will not always be obvious.
    Sandage Bell conducts strategic internal investigations to find or fix allegations of misconduct. Evidence of criminal conduct can arise before or after the government begins its investigation. Grand jury subpoenas; allegations of employees, customers, or competitors; or an internal audit— all may demonstrate criminal conduct within the organization. Only after a thorough analysis of the depth and breadth of the conduct can the client decide whether self-disclosure of the wrongdoing to the government is the best option.
    We conduct independent internal investigations to investigate environmental crimes, customs violations, accounting fraud, and financial crimes. Our investigations allow our clients to understand what happened and decide the appropriate action to take; such as whether to voluntarily disclose the conduct to the government, how to discipline the responsible employees, and whether to preserve or waive the attorney-client privilege regarding the investigation. We also help clients conduct interviews of management and employees by deciding who to interview, handling whistleblowers and cooperators, and constructing measures to prevent the conduct from happening again.
    Federal anti-bribery law was significantly expanded by the Foreign Corrupt Practices Act (FCPA) and the Organization for Economic Cooperation and Development (OECD) Convention. The SEC and DOJ have put unprecedented resources into enforcing these provisions. Sandage Bell represents clients against charges of FCPA violations, bribery, bid-rigging schemes, contracting and program fraud, and public corruption.
    Sandage Bell advises clients on the creation, application, and execution of corporate compliance and ethics programs that are crafted to prevent illegal activity. Today’s corporations must have a compliance program, both to show the company’s dedication to legal business practices and to avoid breaking the law. If the company finds unlawful conduct, an effective compliance program might mean the difference between criminal prosecution and deferred prosecution.
    We craft compliance programs specifically for each client’s needs by considering the existing corporate structure, requirements, and culture. The programs typically encompass creating codes of conduct; conducting employee education; selecting compliance officer and compliance committee; monitoring and auditing procedures; reporting illegal conduct; creating disciplinary policies; and overseeing board and management.

    Sandage Bell represents clients regarding allegations of computer crimes including computer hacking and cyber theft. We are familiar with the Federal Computer Fraud Act and Economic Espionage Act—we know the nuances of the law regarding employee access to corporate computers and we can defend allegations of computer fraud and related crimes. Our attorneys stay abreast of the latest developments in computer technology and forensics and, when necessary, we use experts to compile an all-star defense team.
  • False Claims Act
    We defend individuals and corporations against False Claims Act violations. Additionally, the firm represents corporate clients facing possible suspension or debarment from government contracts, loans and grants—an ominous consequence that comes with charges of criminal conduct. Negotiating with agencies and prosecutors, our attorneys may be able to fashion compromises that permit clients to avoid suspension or debarment.
